Placing a bid constitutes express acceptance of all Terms and Conditions as follows:


Each auction lot will be sold to the highest bidder. In the event of duplicate high bids, the earliest bid recognized by the auctioneer will be accepted. No retractions of bids are permitted. EAC Gallery reserves the right to withdraw any lots. EAC Gallery reserves the right to reject any bids. Some lots may carry a reserve below which the lot will not be sold. EAC Gallery may place bids on behalf of the consignor for such lots up to the reserve.  Max bids placed for those lots with reserves will be automatically bid up to but not above the reserve, or up to the max bid if the reserve exceeds the max bid.  


BUYER'S PREMIUM - There will be a 17-1/2 % Buyer's Premium added to the final hammer price of each auction lot.


PAYMENT is due within 7 days of the conclusion of each auction and may be made by Visa, MasterCard, PayPal to ebay@eacgallery.com, bank check, money order, wire transfer, business check or personal check payable to EAC Gallery. EAC Gallery reserves the right to notify individual bidders should their payment by bank wire transfer be exclusively required. Lots will be shipped promptly upon receipt of payment by credit card, PayPal, or postal money order. Shipping will be held from 10 to 14 business days upon receipt of all other forms of payment. In the event of nonpayment, your agreement to these terms and conditions shall serve as authorization to charge the credit card account you have provided for all purchases and all additional charges. EAC Gallery may impose, and the purchaser agrees to pay, a 1.5% per month late charge on outstanding balances over thirty (30) days after auction date.


BIDDER REGISTRATION is required to bid and may be required prior to the concluding day of each auction.


BIDDING
- New registrants and registered bidders who have an assigned bidder number for this or previous EAC Gallery auctions, may place bids online, by telephone 516-365-0600, by email to auction@eacgallery.com, or by fax to 516-365-5277. A minimum or opening bid is set for each auction lot. No bids below the minimum bid will be accepted. Subsequent bids must be 10% or more above previous bid, rounded up to full dollar. Email, faxed and telephone registrations and bids will be considered valid and accepted only upon receipt of confirmation from EAC Gallery.


All registered bidders may place bids from the time an auction appears on this website or may purchase outright any items offered for sale in the gallery section of this website. Auction bidding will conclude at the stated date and time, with a five minute rule extending the end time of the auction until (a) five minutes have elapsed without bids and (b) all call back requests have been serviced or (c) the auctioneer has determined that the auction shall end. The five minute rule does not guarantee infinite extensions of the auction end time. Bids shall be accepted for all lots until such time as the entire auction has closed.


ABSENTEE, CEILING, MAX OR LIMIT BIDS are accepted. When placing such bids you are instructing EAC Gallery to competitively bid on your behalf up to but not above your highest bid.


SALES TAX - 8-5/8% sales tax will be collected for all lots shipped to all New York State addresses unless a fully executed New York State resale certificate is received prior to the conclusion of the auction.


GUARANTEES
EAC Gallery guarantees the authenticity of all lots without time limit, to the purchaser of record. Disputes of authenticity shall be resolved with the return of lot in exact condition as shipped with no alteration, change in condition or damage, accompanied by (1) proof of purchase, (2) return authorization issued by EAC Gallery, and (3) a written opinion from a recognized expert in the related collecting field who has been deemed acceptable by both buyer and seller, challenging the authenticity. Refund is limited to the total purchase price (total of sale price and any buyer's premium collected).


CONDITION OF LOTS – All framing is sold in “as is” condition. Condition description of lot excludes condition of frame. Framed items not examined out of frame.


NOTIFICATION - Successful bidders will be notified by mail, fax, telephone or email upon the close of auction.


SHIPPING - Via ground UPS or other carrier selected by EAC unless other method has been requested by bidder and confirmed with EAC Gallery. Bidder will be invoiced for packing, insurance and shipping. All lots will be shipped fully insured. Damage to packages must be reported within 24 hours of receipt, all packaging materials must be retained, and insurance claim procedures followed. All customs duties, taxes and fees are solely the responsibility of the bidder.


RETURNS of auction lots will be accepted when received at EAC Gallery within 30 days of the final auction date with no alteration or damage to the condition of the item. A return authorization must be obtained from EAC Gallery prior to shipping all returns. A full refund of hammer price and buyer's premium paid will be promptly issued, no questions asked. RETURNS of all auction lots after the 30 day return privilege has expired and the return of fixed priced purchases will be accepted only for reasons of gross miscataloging or for questionable authenticity. Disputes of authenticity shall be resolved with the return of lot in exact condition as shipped with no alteration, change in condition or damage, accompanied by (1) proof of purchase, (2) return authorization issued by EAC Gallery, and (3) a written opinion from a recognized expert in the related collecting field who has been deemed acceptable by both buyer and seller, challenging the authenticity. Refund is limited to the total purchase price (total of sale price and any buyer's premium collected).


All of these Terms and Conditions of Sale and the purchaser’s and EAC Gallery’s respective rights and obligations are governed by the laws of the State of New York. All bidders and purchasers hereby consent to the jurisdiction of Nassau County, New York.
